Creative & Sporting
This category is for migrants who want to come to the United Kingdom to work or perform as sports people, entertainers or creative artists for up to 12 months.
It does not cover people who currently enter the United Kingdom under the permit-free concessions for entertainers, including permit-free festivals, and sports people. These concessions will be brought within the immigration rules (outside of the points-based system) under the revised visitor categories. More information on the new visitor categories will be published on our website when the Home Office release them.
These migrants will be issued with a certificate of sponsorship number and an additional process will be introduced to enable them to gain entry at the port. More information about this process will be available on this website in autumn 2008, which is when the Home Office inform us the detail will be released. Separate arrangements will allow appropriate checks to be made at the port of entry.
Creative
If you sponsor creative workers in dance, theatre, film and television, you must follow the appropriate codes of practice produced by the sector, and agreed with the UK Border Agency, when considering the needs of the resident labour market in those fields.
The certificates of sponsorship can include any rehearsal periods required. You must make sure that you issue certificates of sponsorship only for the time needed. The UKBA will take appropriate action against you, if they find on a compliance visit that a certificate has been issued wrongly.
You may choose to issue a multiple entry certificate of sponsorship if there are engagements abroad.
Creative Code of Practice
The UKBA have not produced the code of preactice yet. We will update the website when they release this information.
Sporting
You must be able to prove that the migrant is internationally established at the highest level in their sport and/or whose employment will make a significant contribution to the development and operation of that particular sport in this country. Coaches must be suitably qualified to fulfil the role in question.
Although migrants in the tier 5 - sporting category do not need a governing body endorsement to get permission to enter or stay, you must make sure you follow the criteria for that category before issuing a certificate of sponsorship.
A certificate of sponsorship may only be issued in this category if the migrant:
- wants to enter the United Kingdom to work or perform in the relevant sector
- is not intending to establish themselves in business in the United Kingdom
- poses no threat to the resident labour force; and
- will comply with the conditions of their permission to stay and leave the United Kingdom when it expires.
How points are awarded to temporary workers - creative and sporting
You should check any migrants will score a total of 40 points across the different criteria, before issuing your certificate of sponsorship.
